Waiver & Participant Acknowledgement

By booking or participating in any Shalaya experience, retreat, class, workshop, wellness activity, yoga session, treatment, ceremony, excursion, travel arrangement, or related offering, whether for myself and/or for one or more children under the age of 18, I confirm that I have read, understood, and accepted this Waiver and Participant Acknowledgement.

Definitions

“Independent Providers” means all independent professionals, studios, wellness centers, venues, hosts, teachers, practitioners, guides, therapists, drivers, accommodation providers, retreat partners, operators, and other third-party providers delivering any part of a Shalaya experience.

Role of Shalaya

I understand that Shalaya is based in Singapore and acts as an intermediary, curator, booking facilitator, and experience coordinator. Unless expressly stated otherwise in writing, Shalaya does not directly provide yoga instruction, medical care, therapy, transport, accommodation, guiding, bodywork, wellness treatment, or other professional services.

Such services may be delivered by Independent Providers, including in Singapore and other destinations.

Booking for Minors

I confirm that I am at least 18 years old. Where I make a booking for one or more children under the age of 18 (“Minors”), I confirm that I am their parent or legal guardian and have the legal authority to consent to their participation.

By completing the booking, I expressly consent to each Minor’s participation in the relevant experience and acknowledge and accept, in my capacity as parent or legal guardian, the risks, responsibilities, and conditions set out in this Waiver on their behalf, to the fullest extent permitted by applicable law.

This Waiver is intended to apply to my own participation, where applicable, and to the participation of every Minor included in my booking, whether or not I personally attend the experience.

Voluntary Participation and Assumption of Risk

I understand that participation is voluntary and may involve inherent risks, including physical exertion, injury, emotional discomfort, travel-related risks, unfamiliar environments, outdoor conditions, food or allergy-related risks, cultural activities, movement practices, yoga, breathwork, meditation, bodywork, excursions, and group activities.

I knowingly and voluntarily acknowledge and accept the inherent and ordinary risks associated with my participation and/or that of any Minor included in my booking, including risks of physical injury, illness, emotional distress, or other harm. I confirm that I am responsible for assessing the suitability of each experience for myself and/or my Minor(s), taking into account their age, abilities, health, and individual needs.

Health, Medical Conditions, and Professional Advice

I confirm that I am in suitable physical, mental, and emotional condition to participate. I agree to inform Shalaya and/or the relevant provider before the experience of any injury, illness, pregnancy, allergy, disability, medication, medical condition, psychological condition, recent surgery, or other circumstances that may affect my participation.

I understand that Shalaya experiences are not a substitute for medical advice, diagnosis, treatment, or psychotherapy. I should consult a qualified doctor or healthcare professional before participating if I have any medical concern, chronic condition, injury, pregnancy, heart condition, respiratory condition, mental health concern, or if I am unsure whether an activity is suitable for me. Where an experience involves intensive breathwork, ceremonial work, or other practices that may bring up strong emotional or psychological responses, I should consult a qualified mental health professional beforehand if I have any concern about my suitability for such practices.

Health and Supervision of Minors

Where I book for a Minor, I confirm, to the best of my knowledge, that the Minor is suitable to participate in the selected activity. I agree to disclose any relevant medical conditions, allergies, injuries, disabilities, or other health or safety concerns to the relevant Independent Provider before participation.

I acknowledge that I am responsible for complying with the Independent Provider’s age restrictions, parental consent requirements, and supervision arrangements. A booking for a Minor does not automatically imply that the activity is suitable for children or that supervision is provided.

Personal Responsibility During the Experience

I agree to listen to my body, act with care, follow reasonable safety instructions, and stop participating immediately if I feel pain, dizziness, distress, or concern for my wellbeing. I understand that I may decline or modify any activity at any time.

I agree to behave respectfully and safely toward other participants, teachers, hosts, staff, and local communities. I understand that Shalaya or the relevant Independent Provider may exclude me from an experience, without refund, if my conduct is inappropriate, unsafe, disruptive, or fails to follow reasonable instructions.

Independent Providers, Studios, Wellness Centers, and Third-Party Providers

I understand that Independent Providers operate independently and are responsible for their own services, qualifications, insurance, conduct, safety standards, and professional obligations.

To the fullest extent permitted by applicable law, Shalaya is not responsible for the acts, omissions, advice, services, cancellations, changes, negligence, or failure of any Independent Provider.

Release and Limitation of Liability

To the fullest extent permitted by applicable law, I agree, on my own behalf and, to the extent legally permitted, on behalf of any Minor included in my booking, to release and hold harmless Shalaya, its founders, team members, representatives, partners, affiliates, and each Independent Provider involved in the relevant experience from claims, losses, costs, damages, or expenses arising from my participation and/or the participation of any Minor included in my booking, or from third-party services arranged through Shalaya. Nothing in this provision excludes or restricts any liability or legal rights that cannot lawfully be excluded or restricted, including any rights belonging to a Minor.

The Independent Providers involved in the relevant experience are intended to benefit from this waiver and may rely on it to the fullest extent permitted by applicable law.

Nothing in this waiver excludes or limits liability where such exclusion or limitation is not permitted by law, including liability for death or personal injury caused by negligence, fraud, willful misconduct, gross negligence, or any non-excludable consumer rights under applicable law.

Bookings, Changes, and Cancellations

I understand that booking terms, payment terms, cancellation policies, refund conditions, schedule changes, minimum participant requirements, weather-related changes, and third-party provider rules may apply to my booking.

I agree to review and accept the applicable booking terms and cancellation policy before confirming my reservation. I understand that certain payments may be non-refundable where costs have been committed to Independent Providers, subject always to applicable law.

Force Majeure

I understand that Shalaya and Independent Providers are not liable for cancellation, delay, or changes to an experience caused by events beyond their reasonable control, including pandemics or public health measures, natural disasters, civil unrest, government action, or other force majeure events. Any refund in such circumstances is subject to the applicable booking and cancellation policy.

Travel, Documents, and Insurance

Where an experience involves travel, accommodation, outdoor activities, or third-party services, I am responsible for obtaining appropriate travel, health, cancellation, accident, and personal insurance coverage.

I am also responsible for ensuring that I hold valid travel documents, visas, permissions, and health requirements for the relevant destination.

Emergency Assistance

In the event of accident, illness, injury, or emergency involving myself or any Minor included in my booking, I authorize Shalaya and/or the relevant Independent Provider to seek emergency assistance where reasonably necessary. I understand that I remain responsible for any associated medical, transport, insurance, evacuation, or emergency costs incurred on my behalf or on behalf of my Minor(s), unless otherwise required by applicable law.

Governing Law

This Waiver and Participant Acknowledgement is governed by the laws of Singapore, unless mandatory laws of another jurisdiction apply to a specific experience or participant.

Updates to this Waiver

Shalaya may update or amend this Waiver and Participant Acknowledgement from time to time. The version in effect at the time I confirm my booking shall apply to that booking.

Confirmation by Booking

By completing my booking and ticking the acceptance checkbox, I confirm that I have read and understood this Waiver and Participant Acknowledgement, including the risks associated with participation. I expressly agree to its terms for myself and, where applicable, in my capacity as parent or legal guardian of each Minor included in my booking. I acknowledge that this acceptance applies to every participant included in my booking, subject to applicable law.
